Terms and Conditions - "Jenny's Apartments"


Landlord:

1. Arrival / Departure


a) Arrival daily from Monday to Sunday between 14.00 and 18.00.

b) Departure must be made no later than 10.00 am, overdraft of more than 30 minutes will result in the calculation of an additional night.

c) Other arrival and departure times can be arranged individually with the landlord, if this is possible for reasons of capacity and for logistical reasons(a claim cannot be asserted). The renter is obliged to inform the landlord about his estimated time of arrival in advance by telephone or in writing in order to ensure a smooth handover of the keys.

d) If the tenant on the day of arrival without side agreements does not appear until 20.00 clock, the lease is considered terminated and the landlord has the right to release the object for marketing. A proportional refund of the rent due to premature departure cannot be claimed.

e) An arrival and / or a departure on public holidays is generally not possible, unless the landlord agrees.


2. Special requests


are generally possible, but require the express written confirmation of the lessor. A legal claim to this does not exist.


3. Payment and additional costs


a) Upon receipt of the booking confirmation, a rental contract is concluded and a down payment of 20% is due, the down payment is to be transferred to the account of the landlord within 7 days.

b) A deposit of 20% will be required before commencement of travel, which is also to be paid to the account of the landlord, if the payment deadlines are not met, the landlord may withdraw from the contract. c) The non-payment by the tenant is considered a withdrawal and entitles the new renting, in this case our withdrawal and cancellation conditions according to point 4. come into force.

d) Additional costs for water, parking space, W-Lan, bed linen and cleaning agents are not charged and are included in the rental price.

e) A final cleaning fee of 40,00 € apartment will be agreed upon, as well as a deposit for any damages of 150,00 €, which will be refunded on the day of departure if no complaint is made. The deposit must be paid in cash on arrival.

f) The visitor's tax amounts to 1.50 € per person and night and is collected and paid by the landlord, certain groups of persons such as children under 16 years, business travellers are exempt from payment. Disabled persons and their companions receive a reduction of 50%. The landlord needs an appropriate proof for this.

g) Possible other prices on platforms such as Booking, AirBnb etc. are possible, a subsequent price increase or reduction by the landlord does not take place.


5. Obligations of the tenant


a) The tenant undertakes to treat the rented objects (holiday flat, inventory, parking lot and outdoor facilities) with care and to show consideration for the other tenants.

b) If during the tenancy damage occurs to the holiday home and/or its inventory, the tenant is obliged to inform the landlord immediately. Should the tenant discover damage upon arrival, this must also be reported to the landlord immediately, otherwise the tenant is liable for these damages.

c) A reasonable period of time must be allowed to remedy any defects and/or damage. Claims arising from complaints which are not immediately reported to the lessor on site are excluded.

d) In the event of a possible disruption in performance, e.g. water ingress, the tenant undertakes to do everything reasonable within the scope of his legal obligation to keep the rectification of the disruption and possible damage to a minimum.

e) On the day of departure, the tenant's personal belongings must be removed, household waste is to be disposed, crockery has to be stored clean and washed in the kitchen cupboards and the apartment handed over swept clean. 


6. Data protection


The tenant agrees that within the contract concluded with him necessary data about his person will be stored, changed and/or deleted. The data will be passed on to the City of Bad Salzungen as prescribed by the spa fee law (Kurbeitragsgesetz). The landlord is legally obliged to store the personal data for 12 months, thereafter they will be deleted. All personal data are treated absolutely confidentially. 


7. Liability


The marketing was created to the best of our knowledge and belief. There is no liability for any influence on the rented property due to force majeure, power and water failures customary in the country, or thunderstorms. Likewise, no liability shall be assumed in the event of unforeseeable or unavoidable circumstances such as official directives, sudden construction sites or other disruptions caused by natural or local conditions. The lessor will be happy to assist in solving any problems as far as possible. The arrival and departure of the lessee is his own responsibility and liability. The landlord is not liable for theft, fire or water damage to personal belongings. 


8. Final clauses


Photos and texts on flyers or website serve the realistic description, a 100-percent agreement with the rental property can not be guaranteed. The landlord reserves the right to change the equipment (e.g. furniture and fittings) if they are of equal value. The invalid provision shall be replaced by a valid provision which comes as close as possible to the economic and legal intention of the contracting parties. German law shall apply.


Place of jurisdiction is the landlord's place of residence.
